This Privacy Policy describes the types of information Genesis Medtech (USA) Inc. (the “Company”) collects, how the Company uses such information, as well as when and to whom the information is disclosed. This Privacy Policy applies to the Digital Surgery Intelligence Platform (the “Platform”) located at www.surgeryview.ai (the “Site”), and any other personal information obtained through different forms of communications with the Company in connection with the Platform. The Site is intended only for businesses such as medical institutions and medical device companies, individuals operating as professional surgeons, and medical trainees, and not for individual consumers. By accessing the Site on any computer, mobile phone, tablet, or other device or otherwise interacting with the Company users agree to the terms of this Privacy Policy. If users do not agree to the policy, they should not use the Site.
The Company may modify this Privacy Policy at any time and will post the current version on the Site. The Company encourages users to periodically review our Privacy Policy to stay informed about how the Company is using the information it collects.
Information That the Company Collects: Sources, Purpose, and Recipients
The Company collects information from users and various other sources, including users’ web browsers, servers, networks, and other technology incorporated into the site.
The Company may use this information for any of the following purposes: (i) communication with users regarding their accounts and requests for information; (ii) enabling users to access the Company’s services; (iii) providing support in response to users’ communications with the Company; (iv) sending notice of any updates that may be of interest to users; (v) protecting the security or integrity of the Site and the Company’s business; (vi) fraud prevention, unauthorized transactions and managing risk exposure by identifying potential hackers and other unauthorized users; and (vii) in an aggregated non-specific format, for analytical and demographic purposes.
The Company may share this information (as detailed below) with related entities and certain authorized third parties for the purpose of providing specialized services to the Company (such as helping the Company to maintain and manage our user information, communicate with our users, service our website, etc.)
Categories of Personal Information the Company may collect include, without limitation:
A. Account Registration and Contact Information
Users may input, and the Company may collect, each user’s name, address, phone number, email address, password, details about the user’s profession and any other information each user provides when registering for or update an account.
B. Information Automatically Collected from User Browsers
The Company may collect information from users’ browsers, including browser type, operating system type or mobile device model, viewed webpages, clicked links, keystrokes, mouse movement, IP address, mobile device identifier or other unique identifier, sites or apps visited before visiting our Site, time spent viewing or using the Site, frequency of return to the Site, other click-stream or site usage data, and emails the Company send that user open, forward, or click through to our Site.
C. Information Collected from User Devices and Networks
The Company may collect information that is automatically collected from each user’s device and internet network based on user input and the Site’s technology. This information may include user’s respective internet service providers, internet protocol or IP address, domain names of the computers used to visit the Site, the operating system and browser used, and the type of handheld or mobile device used, as well as any Uniform Resource Identifiers of the resources requested, the time and method of submission for each request, size of the file obtained in reply, numerical status codes of server replies (successful, error, etc.), and other parameters concerning the user’s operating system and computer environment, and/or device cookie settings and other device details.
D. Other Voluntary Information
The Company may also collect any voluntary information that its users may provide in the course of their interactions with the Company (i.e. via email or telephone). The Company uses this information to handle requests and to contact users when necessary or requested, including responding to questions and comments, and providing support.
No Protected Health Information
When physicians utilize [the platform], they must not submit or share any protected health information subject to the Health Insurance Portability and Accountability Act (“HIPAA”), which may include patient names or the dates of surgical procedures.
Information Collected Automatically
The Company may analyze how visitors use our Site through what is known as “cookie” technology or similar tracking tools. A cookie is a small text file that is placed on users’ computers accessing the Site. Cookies allow the Company to recognize users each time they visit the Site. The Company may use cookies to: (1) allow users to use the Site without having to re-enter usernames and passwords; (2) enhance or personalize Site usage experience; (3) monitor Site usage; (4) manage the Site; and (5) improve the Site and services. Users can set their browsers to reject cookies, or manually delete individual cookies or all of the cookies on their computer by following their respective browser’s help file directions. However, if a browser is set to reject cookies or users manually delete cookies, they may have some trouble accessing and using some of the pages and features that are currently on the Site, or may be on the Site in the future. Note that browser-management tools for cookies are outside of the Company’s control and the Company cannot guarantee their effectiveness.
The Company may combine the information it collects through cookies, web beacons, or other technology tools with other information it has collected from users or other sources.
Some Internet browsers include the ability to transmit “Do Not Track” signals. Since uniform standards for “Do Not Track” signals have not yet been adopted, the Company does not process or respond to “Do Not Track” signals.
Use of Information
The collected information may be used for the following purposes: (1) to perform contracts with users; (2) to respond to inquiries; (3) to review Site usage and operations; (4) to address problems with the Site, the Company’s business or services; (5) to protect the security or integrity of the Site and the Company’s business; (6) to monitor the Site for compliance with the Company’s Terms of Use and the law; and (7) to contact users with Site updates, newsletters and other informational or promotional materials (from the Company and third party marketing offers from our trusted partners, as well as from other companies).
Users who sign up for the Company’s mailing list, will receive informational emails about offers of services. At any time, users can “unsubscribe” from the email list simply by clicking the “unsubscribe” button.
Disclosure of Information
The Company may disclose information collected from and about its users: (1) to related companies and service providers, to perform a business, professional or technical support function; (2) as necessary if the Company believes that there has been a violation of the Site Terms of Use or of the Company’s rights or the rights of any third party; (3) to respond to legal process (such as a search warrant, subpoena or court order) and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and (4) in the event that the Company or substantially all of its assets are acquired, in which case personal information may be one of the transferred assets. The Company may also disclose personal information with users’ express consent. The Company may share aggregate, non-personally identifiable information about Site users with third parties. Unless users expressly give the Company permission in writing to do so, the Company will not sell, rent, license, share or trade users’ personal information other than as specified in this Privacy Policy.
Please note that upon voluntarily submitting any personal information for posting on the Site, including in the course of uploading a video, the information becomes publicly available and can be collected and used by others, so users should exercise care before posting information online.
Access, Correction, & Deletion
The Company respects the right to access and correct personal information. Users may access their personal information by signing into their accounts. From there, users can correct or modify their information. Users may also exercise their rights, subject to applicable laws and as explained below, to make requests regarding personal data. The Company may need to retain users’ personal data for legal purposes, which will be explained to users if necessary.
If users need assistance correcting or updating personal information, or would like to request deletion of personal information, please contact the Company using the contact information detailed in the “Contact Us” section below.
Retention of Personal Information
The Company may retain users’ personal information for as long as necessary to fulfil the purpose for which it was collected or to comply with legal or regulatory requirements. The criteria used to determine our retention periods include: (a) the length of time the Company have an ongoing relationship with each user and provides services, (b) whether there is a legal obligation to which the Company are subject, and (c) whether retention is advisable in light of the Company’s legal position (e.g. applicable statutes of limitations, litigation or regulatory investigations). The Company retains personal information for one year following the end of services or other business relationships in accordance with applicable law.
Security
The Company maintains reasonable and appropriate measures designed to maintain information collected securely. There are certain physical, electronic, and administrative safeguards in place to secure the information collected from Site visitors. Even though the Company follows reasonable procedures to try to protect the information in its possession, no security system is perfect and the Company cannot promise, that each user’s information will be secure in all circumstances.
Children
The Site is not directed to children, nor does the Company knowingly collect any personal information from children under the age of eighteen without verifiable parental consent. If any user believes that a child has provided personal information to the Company, please contact the Company promptly as described below, and the Company will endeavor to investigate and delete such information from its systems. Minors under 18 years of age may have the personal information that they have provided to the Company through this Site deleted by sending an email to support@surgeryview.ai requesting deletion. The Company does not have actual knowledge about selling or sharing personal information of consumers under the age of 18.
Third Party Websites
The Site may contain links to third-party websites for convenience and additional information. These websites may have privacy policies that differ from the Company’s own. The Company is not responsible for the activities and practices that take place on these websites. Accordingly, the Company recommends that users review the privacy policy posted on any external site before disclosing any personal information. Please contact those websites directly for any questions about their privacy policies.
Changes to This Privacy Policy
The Company may change this privacy policy from time to time, including as required to keep current with rules and regulations, new technologies and security standards. The Company will post the change(s) on our Site. If the policy is changed in a material and retroactive manner, the Company will provide appropriate notice to its users.
California Privacy Rights
For users who are California residents, and the Company receives their personal information in the form of contact details on its website or otherwise, the Company may use the contact and business details to maintain business contacts. For this purpose, the Company may transfer users’ contact details to our internal database. Pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, “CCPA”), California resident users have privacy rights with respect to business contact personal information.
The processing activity may include the following categories of personal information:
• Contact information (e.g., name, title, form of address or salutation, address, telephone numbers, email address); and
• Details of each user’s profession (e.g., job title, position, personnel number, place of work, department, qualifications).
This data processing is based on legitimate business interests. The Company has a legitimate economic interest in maintaining contacts beyond the initial context and in using them to establish and develop a business relationship and to remain in contact with the parties concerned.
Such business contacts could also be easily processed in the Company’s email communications with users, and kept in typical business software, either centrally or on the electronic devices of the Company’s employees.
California law provides its users with the following rights with respect to their personal information:
• The right to know what personal information the Company has collected, used, disclosed and sold about them.
• The right to request that the Company delete any personal information it has collected about them.
• The right to correct inaccurate personal information about them.
When users exercise these rights and submit any request to us, the Company will verify users’ identities by asking users to log in to their accounts if they have one with the Company. If any user does not have an account with the Company, the Company may ask for their email address or phone number. The Company also may use a third-party verification provider to verify a user’s identity.
Submitting Requests
California residents have the right to opt out of the selling and sharing of their personal information and to limit the use of their sensitive personal information. However, the Company does not sell or share personal information, and does not collect or use sensitive personal information, unless users are given notice of those additional purposes.

The Company will respond to each user’s request in compliance with the requirements of applicable laws. Please note that the Company is only required to honor California requests to know twice in a 12-month period.
The Company does not discriminate against California residents who exercise any of their rights described in this Privacy Policy. Any exercise of these rights will have no adverse effect on the price and quality of our goods or services.
Authorized Agents
Users may permit an authorized agent to submit a request to know or to delete their personal information. If the Company receives a request on as user’s behalf, the Company will ask the requesting person to provide proof that such user gave that person written permission to make a request on their behalf. If that person does not provide the Company with written proof, the Company will deny the request so that the user’s personal information is protected.
Automated Decision-Making
The Company generally does not use automated decision-making technology, as that term is defined by state privacy laws. If the Company makes use of automated decision-making technology, users will be informed through a separate privacy notice.
California law also permits users who are California residents to request certain information about the Company’s disclosure of personal information to third parties for their own direct marketing purposes during the preceding calendar year. This request is free and may be made once a year. To make such a request, please write to the Company as described below in “Contact Us.”
Visitors from Outside the United States—Cross-Border Transfer
The Site is hosted and operated primarily in the United States. If users visit the Site from outside the United States, their information may be transferred to, stored and processed in the United States or other countries in accordance with this Privacy Policy. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in international users’ countries, or may otherwise differ from the data protection or consumer protection laws in other countries. International users’ information may be available to government authorities under lawful orders and laws applicable in such jurisdictions. By using the Site and/or providing personal information to the Company, users consent to the transfer of their information to the Company’s facilities as described in this Privacy Policy.
